HLT 308v topic 3 Discussion Question 1 The Patient Self-Determination Act

Health care professionals should always adhere to medical ethics regardless of patients and their health complexities. Patient autonomy is among the core ethical principles that underline the importance of respecting patients’ individual decisions (Kollisch et al., 2021). However, patients are not always physically and cognitively able to make autonomous decisions. As a result, advance directives provided under the Patient Self-Determination Act (PSDA) ensure patients’ rights and wishes are respected when critically ill or during end-of-life. Advance directives ensure that health care professionals respect patients’ values and preferences regarding medical treatment (Porteri, 2018). Ethics committees guide the implementation of advance directives and resolve conflicts from contentious decisions.

In guiding the implementation of advance directives, an ethics committee has a professional responsibility to intervene on behalf of the patient. As Porteri (2018) posited, an ethics committee ensures that patients’ dignity, safety, and rights are respected when making critical health decisions. Since medical treatments against a patient’s wish breach the autonomy principle and risk patient safety, an ethics committee ensures the advance directive is implemented in its entirety. The implication is that despite the significance of beneficence and non-maleficence, the principle of autonomy overrides them in the case of an advance directive.

An ethics committee also helps to resolve conflicts and guide health care professionals in complicated situations. As House et al. (2022) explained, decision-making conflicts are possible when an advance directive is for a child. The assumption is that a child is mature and understands the illness before writing the directive. A suitable example is during the treatment of advanced dementia. Later, parents may decide to intervene differently against what the advance directive recommends. Such situations necessitate the intervention of an ethics committee due to their complexity and far-reaching outcomes on health and relationships with patients and their families.

Assessment Description
The Patient Self-Determination Act (PSDA) was implemented to allow patients to state “Do Not Resuscitate” (DNS), or to assign a surrogate decision maker in the event that the individual is unable to make the decision. What relationship does an ethics committee have in enforcing the advance directives of the patients in their care? Support your analysis with a minimum of one peer-reviewed article.

Assessment Description
The Center for Medicare and Medicaid Services (CMS) publishes a list of healthcare-acquired conditions (HACs) that reasonably could have been prevented through the application of risk management strategies. What actions has your health care organization (or have health care organizations in general) implemented to manage or prevent these “never events” from happening within their health care facilities? Support your response with a minimum of two peer-reviewed articles.
